These Terms and Conditions ("Terms") govern your use of the website https://www.atlasmedia.house and the services provided by Atlas Media House LLC ("Atlas Media House," "we," "us," or "our"). By using our website or booking our services, you agree to these Terms.

1. Services

Atlas Media House LLC provides real estate photography, videography, aerial drone media, and related services for real estate agents and property owners in New Jersey. Specific deliverables, pricing, and terms are confirmed at the time of booking.

2. Booking & Payment

  • Bookings are confirmed upon receipt of payment or a signed agreement, as applicable.
  • Pricing is listed on our website and subject to change without notice. Pricing confirmed at time of booking is honored for that booking.
  • Payment is due at or before the time of the shoot unless other arrangements are made in writing.

3. Cancellations & Rescheduling

  • We request a minimum of 24 hours notice for rescheduling or cancellation.
  • Cancellations made with less than 24 hours notice may be subject to a rescheduling fee.
  • We reserve the right to reschedule shoots due to weather, equipment failure, or other circumstances beyond our control. In such cases, we will work with you to find the earliest available alternative date.

4. Delivery

  • Standard delivery for photos is within 24 hours of shoot completion. Video delivery is within 3–5 business days.
  • Delivery timelines are estimates and not guaranteed in cases of extenuating circumstances.
  • Files are delivered via digital download link. Download links are active for 30 days.

5. SMS Communications

Program Description

Atlas Media House LLC operates an SMS messaging program to send clients booking confirmations, shoot reminders, delivery notifications, and occasional service updates or promotional messages.

Consent

SMS messages are only sent to individuals who have explicitly opted in by checking the SMS consent checkbox on our website or booking form. Consent is never required as a condition of purchasing our services or booking a shoot.

Message Frequency

Message frequency varies. You may receive multiple messages per booking (confirmation, reminders, delivery notification, follow-up). Promotional messages are sent infrequently.

Message and Data Rates

Message and data rates may apply. Check with your wireless carrier for applicable rates.

Opt-Out Instructions

You can opt out of SMS communications at any time by replying STOP to any message from Atlas Media House. After opting out, you will receive one final confirmation message and no further messages will be sent.

Supported Carriers

Our SMS program is supported by all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier support is not guaranteed for all carriers or devices.

6. Intellectual Property & Usage Rights

  • Atlas Media House retains copyright ownership of all photographs and video produced.
  • Upon full payment, clients receive a non-exclusive license to use delivered media for real estate marketing, MLS listings, social media, and personal promotional purposes.
  • Resale or sublicensing of media to third parties requires written permission from Atlas Media House LLC.
  • We reserve the right to use media from shoots in our portfolio and marketing materials unless you request otherwise in writing before the shoot.

7. Drone Operations

All aerial photography and videography is conducted in compliance with FAA regulations. Clients are responsible for ensuring that local ordinances, HOA rules, or airspace restrictions do not prohibit drone operations at the shoot location. We reserve the right to decline or modify drone services if safe and legal operation is not possible.

8. Limitation of Liability

To the maximum extent permitted by law, Atlas Media House LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our services. Our total liability for any claim is limited to the amount paid for the specific service giving rise to the claim.

9. Indemnification

You agree to indemnify and hold Atlas Media House LLC harmless from any claims, losses, or damages arising from your use of our services or breach of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

11. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services constitutes acceptance of updated Terms.
